Terms and Conditions of Sale (TCS)

These Terms and Conditions of Sale (hereinafter referred to as "TCS") govern all sales made on the KinkyPlayzone website (hereinafter referred to as "the Site") and define the rights and obligations of both parties in the context of selling digital content to adult customers worldwide.

By placing an order on the Site, the customer acknowledges that they have read, understood, and unreservedly accepted these TCS.

2. Scope of Application

These TCS apply to all sales of digital content offered on the Site, including but not limited to:

• Downloadable videos, accessible via a secure link provided to the customer after payment.
• Streaming videos (if and when this feature is made available).

These TCS are available at any time on the Site and prevail over any other contradictory document.

3. Age Restriction

The content offered by KinkyPlayzone is strictly intended for adults only (18 years or older, or the legal age of majority in the customer’s country).

By accessing the Site and making a purchase, the customer certifies that they:

• Are of legal age according to the laws of their country.
• Are accessing this content for personal and private use only.
• Will not share, display, or make the purchased content accessible to minors.

4. Digital Products Offered

The products sold are digital videos intended for strictly private and non-commercial use.

The customer is granted a personal license to view the purchased content.
Any reproduction, distribution, resale, public display, or sharing of the content, in whole or in part, is strictly prohibited and may result in legal action.

5. Orders

To place an order, the customer must:

1. Select the desired video(s) and add them to the cart.
2. Provide the necessary information for order processing, including a valid email address to receive the download link.
3. Proceed with payment through the secure payment system provided on the Site.

Once the order has been validated and payment confirmed, the customer will receive a confirmation email containing:

• A summary of the order.
• A link to download or stream the purchased video.

6. Prices and Taxes

All prices displayed on the Site are expressed in euros (€).

In accordance with Article 293B of the French General Tax Code (CGI), KinkyPlayzone operates under the micro-enterprise regime and is not subject to Value Added Tax (VAT).

Consequently, VAT is not applicable, regardless of the customer’s country of residence.

Additional fees, such as bank charges or currency conversion fees, may be applied by the customer’s financial institution and remain the customer’s sole responsibility.

7. Payment

Payments are processed through a secure third-party payment provider, ensuring the confidentiality and security of transactions.

The Site does not store any banking or payment data from customers.
An order is considered final only after confirmation of the payment by the payment provider.

8. Delivery of Digital Content

After the payment has been validated, the customer will receive:

• A download link or streaming access, provided immediately or within a very short timeframe.
• This link is strictly personal and must not be shared with anyone else.

Customers are strongly encouraged to download their purchased video as soon as they receive the link, as the link may have a limited validity period.

9. No Right of Withdrawal

In accordance with Article L221-28 of the French Consumer Code, the customer expressly waives their right of withdrawal once:

• Access to the digital content has been provided,
• Or the download has begun with their prior consent.

As a result, no refunds will be issued after the digital product has been delivered.

10. Liability

KinkyPlayzone shall not be held liable for:

• Any misuse of the purchased content by the customer.
• Technical issues related to the customer’s hardware or internet connection.
• Temporary or permanent unavailability of the service due to force majeure or maintenance.

The customer is solely responsible for:

• Securely storing their download links and access credentials.
• Complying with local laws regarding the access and consumption of adult content.

11. Intellectual Property

All content available on the Site (videos, text, images, logos, etc.) is protected by copyright and international intellectual property laws.

Purchasing a digital product does not transfer any intellectual property rights to the customer.
Any unauthorized use, including copying, sharing, or distribution, is strictly prohibited and may lead to legal action.

12. Personal Data

The Site collects only the data necessary to process orders and issue invoices.

All data is processed in accordance with applicable laws, including the General Data Protection Regulation (GDPR).

13. Governing Law and Disputes

These TCS are governed by French law.

In the event of a dispute, both parties agree to seek an amicable resolution first.
If no agreement can be reached, the French courts shall have exclusive jurisdiction.

14. Changes to the TCS

KinkyPlayzone reserves the right to modify these TCS at any time.
The version applicable to a given order is the one in effect at the date of purchase.
